An Anastasia Island address can fall under three governments. Davis Shores and Lighthouse Park are inside the City of St. Augustine, where the historic districts need a certificate of appropriateness and the city's tree rules apply. The incorporated beach is the City of St. Augustine Beach, with an impervious cap of 0.40 on low-density lots and a permit needed to remove a tree (St. Augustine Beach code). Butler Beach, Crescent Beach and the rest of the island are unincorporated St. Johns County, with no city architectural board and no city impervious cap. Marsh Creek, the gated community in unincorporated St. Johns County, doesn't ban artificial grass outright. A lot that borders the community golf course also carries a separate easement for ordinary play, and the same declaration requires fencing or improvements next to the course to be strictly reviewed so they don't interfere with a shot, worth knowing before you plan a green's outline or fence line on a course-side lot. Fla. Stat. 720.3045 keeps an association from blocking turf that meets Florida's standard on the part of a lot no one can see from the frontage, the next lot, a common area or a community golf course; on a course-side lot, whether a green would be visible from play is exactly what the ARB decision turns on. One state law holds across all three: a city or county can't ban turf that meets Florida's standard on a single-family parcel up to an acre ([Fla.
